C2C Best Practice Forums

Martindale-Hubbell® has been hosting Counsel to Counsel Best Practice Forums throughout the world since 2000. These sessions, which bring together senior corporate counsel and partners at law firms, are designed to facilitate the exchange of ideas and best practices regarding corporate legal department management.
Dozens of forums have been held from Paris to Singapore and Chicago to Houston. These unique sessions provide corporate counsel with an opportunity to engage in meaningful dialogue about the key issues they are facing. Topics range from Managing Corporate Crisis to Balancing Local and Regional Laws in a Global Business.
Based upon the successful forum series, Counsel to Counsel magazine focuses on current issues and practical approaches in corporate legal services, offering cutting-edge benchmarking information and timely insights from in-house counsel and their trusted legal advisers worldwide. If you are interested in contributing editorial content to Counsel to Counsel magazine, or would like to receive issues by e-mail, send an e-mail to counseltocounselmag@martindale.com.

Key Learnings From Past Forums

Best Practices: Project Management: New Product Review-15 Countries, Five Days from the September 25, 2008 session in New York. Situation: In this case, we use a hypothetical situation. Imagine that eBay is considering a new Web site called "eBay Barterland" in 15 countries. It will launch in major markets in the United States, Germany and the United Kingdom and other markets in Europe and Asia. Users will list items and services they wish to swap. eBay will charge a listing fee while assuming no responsibility for the transactions. Potential issues include liability for illegal products or services; fraudulent transactions or substandard merchandise; domestic and international tax and revenue recognition issues; and possible false advertising claims. eBay has local in-house lawyers in each of the 15 countries, along with regional subject matter experts. Best Practices: Multinational Transactions-Assembling the Right Team from the September 25, 2008 session in New York. Situation: A European company bids to provide service solutions to a company in the Middle East. It spends substantial resources preparing its bid. At the eleventh hour, the company hires an international business consultant to help it understand the cultural lay of the land. The project is ultimately awarded to another company. The consultant believes the company may have only been used to drive down the winning bidder's price. Read more...
Best Practices: Implementing an Enterprise Risk Management Evaluation from the June 17, 2008 session in Chicago. Situation: Standard & Poor's (S&P) announced in May that it will
soon make Enterprise Risk Management (ERM) programs at nonfinancial companies part of its comprehensive ratings review. According to a recent survey, roughly 75 percent of nonfinancial companies either do not have or have just begun implementing an ERM process. In spite of that lack, S&P expects companies to have at least begun establishing a systematic approach to ERM within the next year. Additionally, after several boards were blamed and some directors were forced out earlier this year for company losses stemming from missed credit market risks, boards of directors want to know what companies are doing to build credible ERM programs. Best Practices: Critical Analysis in Transactions--Being a Thought Partner from the June 17, 2008 session in Chicago. Situation: Privately held HAVI Group global divisions occasionally propose acquisition (or divestiture) opportunities. However, the Chicago-based company does not have an integrated in-house legal or acquisition group. Further, the countries and/or regions in which it does business sometimes present unique cultural challenges. Read More...
Best Practices: On-Boarding the Board from the May 1, 2008 session in New York City. In the post-Sarbanes-Oxley era, many companies are increasing the independence and efficacy of their boards by bringing in "fresh blood". While new directors add needed expertise and perspective, they may have little or no experience in how to function effectively as a board member. Training is critical to helping these board members understand the company's business and hastening their ability to add value on a long- and short-term basis. Read more...

Feature Article from Counsel to Counsel News:
NYSBA Survey: Economy is no. 1 Issue for In-house Lawyers. A sign of how tough things are for global in-house counsel came in September 2008, with the publication of the New York State Bar Association’s first Global Change Survey. Almost 40% of the global in-house counsel surveyed voted the economic downturn as the single biggest factor affecting their legal department. Read more...

Overview

Counsel to Counsel forums offer participants the opportunity to share business experiences and professional insights "off-the-record," in a relaxed, informal atmosphere. Together, participants examine best practices for navigating the complex issues facing in-house counsel today.

In each workshop-type discussion, 12 to 18 senior corporate counsel engage in a high-level dialogue about innovative ways to manage a corporate legal department. Up to six partners from co-hosting law firms also participate, all lead by two corporate counsel co-chairs and a professional facilitator.

In addition, a cocktail/coffee break during the discussion facilitates social interaction among the participants.

Through this unique format, both in-house counsel and law firm participants benefit from an open, dynamic and multifaceted discourse.

A Proven Resource
Since 2000, Martindale-Hubbell has developed over 100 Counsel to Counsel (C2C) forums around the globe. Senior corporate counsel from the world's most respected enterprises — including American Express, Microsoft, Procter & Gamble, Wm. Wrigley Jr. Company and Sony — have emerged from their Counsel to Counsel forums equipped with new practices and perspectives in legal department management.

A Meeting of Equals
There's no more efficient way to gain a fresh perspective on the legal issues that impact your corporation's success than to leave your office behind and exchange ideas and information with the best of your peers.

C2C forums are organized to provide the highest value for your time. They are not panel discussions, nor are they venues for a sole presenter. Rather, each is an opportunity for a select group of legal professionals to roll up their sleeves and candidly share business experiences and professional insights. Some of the elements that contribute to the uniqueness of the Counsel to Counsel experience include:

  • C2C forums are professionally moderated to ensure that the conversation remains focused and to the point. The facilitator is joined by corporate counsel co-chairs with extensive experience on the topic.
  • C2C forums are free and are for the exclusive benefit of corporate counsel. You may receive up to 3.5 CLE credits for attending.
  • C2C forums provide a wide variety of perspectives. Each participant brings a best practice or case study to the forum for exploration or reflects on a lesson learned.
  • C2C forums can help you build your professional network. The session includes a cocktail/coffee break to allow you to further connect with your colleagues.
